Terms of Service

Effective May 26, 2026. These Terms are a binding agreement between you and ServiceCastle, Inc. governing your use of our website, applications, and services.

1. Acceptance of Terms

ServiceCastle is a software-as-a-service platform for home-service and field-service businesses, providing scheduling, dispatch, customer records, invoicing, payments, and customer communications by email, voice, and SMS. By accessing or using ServiceCastle (the “Services”), you agree to these Terms of Service (“Terms”), our Privacy Policy, and our use of cookies as described in the Privacy Policy and in the cookie banner shown on first visit. If you are using the Services on behalf of a business, you represent that you have authority to bind that business (the “Customer”) to these Terms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract in the United States to use the Services.

3. Accounts

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at support@servicecastle.com of any unauthorized use.

4. Acceptable use

  • No unlawful, harmful, deceptive, or infringing use.
  • No spam, scraping, reverse engineering, or interference with the Services.
  • Do not send communications (email, voice, or SMS) to recipients who have not consented or who have opted out.
  • Do not use the Services to send content prohibited by carrier or messaging-industry rules — including the CTIA's “SHAFT” categories (sex, hate, alcohol, firearms, tobacco) unless your program is properly registered and age-gated, controlled substances (including cannabis and CBD), high-risk financial services (e.g., payday loans), gambling, get-rich-quick or pyramid schemes, debt collection that violates the FDCPA, or phishing/deceptive content.

5. Email, voice, and SMS — Customer responsibilities

From ServiceCastle to you. By providing your email address or mobile phone number and opting in, you agree that ServiceCastle may contact you by email, voice, and SMS (including via an automatic telephone dialing system or prerecorded/ AI-generated voice where applicable) for purposes including:

  • Account, security, and transactional notices.
  • Appointment reminders, job updates, and dispatch alerts.
  • Customer support responses.
  • Marketing and product updates, where you have separately opted in.

Consent to marketing messages is not a condition of purchase. Message frequency varies. Message and data rates may apply. You can opt out of SMS at any time by replying STOP to any message, or reply HELP for help. You can opt out of marketing email using the unsubscribe link in any message. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for more information.

Customer-sent messages (10DLC / A2P) and provisioned phone numbers. ServiceCastle may provision local 10DLC, toll-free, or short-code phone numbers to Customers and route email, voice, and SMS through telecom providers (such as Twilio). When a Customer sends communications through the Services, the Customer is the “sender” and is solely responsible for:

  • Obtaining and documenting each recipient's prior express consent before sending any text message, and prior express written consent before sending any marketing or promotional text message, in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, CTIA Messaging Principles & Best Practices, carrier 10DLC and toll-free verification rules, and applicable state law (including the Florida Telephone Solicitation Act and similar “mini-TCPA” laws).
  • Disclosing at the point of opt-in: program name, message frequency, “Msg & data rates may apply,” how to opt out (STOP) and get help (HELP), and links to the Customer's privacy policy and terms.
  • Maintaining accurate records of consent and honoring opt-outs within the timeframes required by law (immediately for SMS).
  • Registering brands and campaigns where required (e.g., 10DLC registration via The Campaign Registry), submitting truthful campaign information, and only sending traffic that matches the registered use case and sample messages.
  • Where required by law, providing notice and obtaining consent before recording voice calls.
  • All content sent through the platform and all claims by message recipients, carriers, or regulators arising from that content.

ServiceCastle reserves the right to suspend or terminate any campaign, phone number, or account that violates these Terms, the Acceptable Use rules above, carrier requirements, or applicable law, and to cooperate with carrier audits and regulator requests.

6. Subscriptions, fees, and payment

Paid Services are billed in advance on a recurring basis. Pass-through telecom fees (e.g., per-message and per-minute charges, carrier surcharges, 10DLC registration and campaign fees, toll-free verification fees, number rental fees) may be charged in addition to subscription fees and are billed as incurred. Fees are non-refundable except as required by law or expressly stated. You authorize us to charge your payment method on file for all applicable fees and taxes.

7. Customer data and license

You retain ownership of data you submit to the Services (“Customer Data”). You grant ServiceCastle a worldwide, non-exclusive license to host, process, and transmit Customer Data solely to provide and improve the Services. You represent that you have the rights and consents necessary to submit Customer Data, including consents required to send email, voice, or SMS to recipients.

8. Third-party services

The Services may integrate with third-party services (e.g., payment processors, messaging and telecom providers such as Twilio, calendar and accounting tools). Your use of those services is governed by their terms and acceptable-use policies, including Twilio's Messaging Policy and Acceptable Use Policy.

9. Intellectual property

The Services, including all software, content, and trademarks, are owned by ServiceCastle or its licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

10. Cookies

The site uses strictly necessary, functional, and analytics cookies. When you first visit, a cookie banner lets you accept all cookies or limit us to strictly necessary cookies; your choice is stored in your browser. See our Privacy Policy for details.

11. Termination

You may cancel your subscription at any time. We may suspend or terminate the Services if you violate these Terms or to protect the Services or other users. Upon termination, your right to use the Services ends immediately, and provisioned phone numbers will be released according to carrier rules.

12. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any specific message will be delivered, that delivery will be timely, or that carrier filtering will not affect message throughput.

13. Limitation of liability

To the maximum extent permitted by law, ServiceCastle will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our aggregate liability for any claim arising out of or relating to the Services will not exceed the fees you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold ServiceCastle harmless from any claims arising out of your Customer Data, your use of the Services, messages sent through phone numbers we provision to you, your violation of these Terms, or your violation of any law or third-party right (including TCPA, CAN-SPAM, FTSA, CTIA guidelines, carrier 10DLC rules, and applicable state laws relating to email, voice, and SMS).

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section limits either party from seeking equitable relief in any court of competent jurisdiction.

16. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.
